These Terms of Service ("Terms") are a binding agreement between you ("you" or "user") and Jade Email, LLC, a New York limited liability company ("Jade," "we," "us," or "our"). They govern your access to and use of the Jade Email service.
By creating an account or otherwise using Jade, you agree to these Terms. If you do not agree, do not use Jade.
Jade is offered only to individual consumers who are at least 18 years old and able to form a binding contract. By using Jade, you represent that you meet these requirements. Jade is a personal email service and is not offered for business, organizational, or enterprise use.
Jade is an email service that lets you create email addresses and inboxes on a domain you either purchase through Jade or connect yourself ("bring your own domain"). Jade is provided through web and native applications, and the web application may also be installed as a Progressive Web App (PWA). Jade supports connecting external mail clients over IMAP and SMTP, and exposes a Model Context Protocol (MCP) interface that you may use to connect your own AI agent. Jade also provides a deterministic rules and categorization system, including features to automatically unsubscribe from marketing email and to bounce mail sent to a given inbox.
We may change, add, or remove features at any time. Jade is for personal use only.
Third-party clients and integrations. If you connect a third-party mail client (over IMAP or SMTP) or any other third-party software to Jade, you do so at your own risk. Jade is not responsible for third-party clients, applications, or integrations, or for how they handle your email.
You must provide accurate information when registering and keep it current. You are responsible for safeguarding your credentials and for all activity that occurs under your account. Notify us promptly at support@jade.email if you suspect unauthorized access. We are not liable for losses arising from your failure to secure your account.
Jade offers a free plan at no charge. No payment card is required, and the free plan has no end date. On the free plan you receive email at a subdomain that Jade provides, and you cannot send email. Sending email and using your own domain require a paid subscription under Section 5. Subscribing is your choice, and nothing is charged unless you subscribe.
Jade offers one or more paid plans. The plans available, their prices, and any limits on availability are described at signup and on our pricing page, and may change from time to time. Some plans may be offered at our discretion or in limited quantity.
Payments are processed by Stripe. By providing payment information, you authorize us (through Stripe) to charge the applicable fees. Any plan that renews on a recurring basis renews automatically at the then-current price unless you cancel before the renewal date. We may change our prices; changes will not affect your current paid term but will apply to subsequent renewals, and we will give you at least 30 days' advance notice by email or by posting notice within the service.
Taxes. Listed prices may not include sales tax, VAT, or similar taxes. Where we are required to collect such taxes, they will be calculated and added at checkout; otherwise, you are responsible for any taxes due on your purchase.
Domain purchases are separate. When you purchase a domain through Jade, the domain registration fee is paid directly to IONOS (the registrar) and is not collected or refunded by Jade. See Section 7.
You may request a refund of a Jade subscription fee within 14 days of payment, or as otherwise required by applicable law. After 14 days, fees are non-refundable except where required by law. If you cancel mid-term, your subscription is not prorated, but your access to Jade continues until the end of your current paid term. Domain registration fees are not refundable by Jade because they are paid directly to IONOS.
Purchased domains. Domain purchases are facilitated through Entri, and domains are registered through IONOS as the registrar. You are the registrant and sole owner of any domain you register, and Jade has no ownership of or control over it. Domain registration is governed by IONOS's registrar agreement and applicable ICANN policies, which are separate from these Terms. Jade is not responsible for domain registration, renewal, transfer, suspension, loss, or any dispute concerning a domain.
Bring your own domain. If you connect a domain you already own, you do so by pointing your DNS/MX records to Jade. You retain full ownership and control of that domain.
Effect of cancellation. Because you own your domain, cancelling or losing access to Jade does not affect your domain registration; the domain remains registered to you at IONOS.
Jade is a personal email service. You agree not to:
- Send spam or bulk unsolicited email;
- Use Jade for email marketing or as a bulk-sending / email service provider platform (Jade is not a service like Mailchimp);
- Use Jade for any unlawful purpose or to send, store, or distribute illegal content;
- Harass, threaten, or abuse any person, including Jade staff (verbal, written, or otherwise — abuse of Jade staff will result in immediate termination);
- Attempt to disrupt, overload, probe, or interfere with Jade's infrastructure or security;
- Circumvent or attempt to circumvent any usage limits, access controls, or technical restrictions of the service;
- Reverse engineer, decompile, or attempt to derive the source code of any portion of Jade, except to the extent applicable law prohibits this restriction;
- Use automated means — including bots, scrapers, or scripts — to access, abuse, or extract data from Jade beyond the documented programmatic interfaces (IMAP, SMTP, and MCP);
- Share your account with others or allow multiple people to use a single account; or
- Resell, sublicense, or commercially redistribute access to Jade.
We may suspend or terminate accounts that violate this Section. We may also throttle, rate-limit, or suspend access to the programmatic interfaces (such as IMAP, SMTP, or MCP) if we detect abusive usage patterns or activity that risks the stability or security of the service.
Fair use of unlimited features. Although Jade offers unlimited email addresses and inboxes, this is intended for ordinary personal use. We may contact you, and may limit or suspend your account, if your usage is materially excessive compared to typical personal use or negatively affects the service for other users.
As between you and Jade, you own the content of your email (message bodies, attachments, and related data). You are solely responsible for your content and for ensuring you have the right to send, receive, and store it.
You grant Jade a limited license to host, store, back up, process, transmit, and display your content solely as necessary to operate and provide the service to you (including running the deterministic rules and categorization system). This license ends when your content is deleted, subject to the backup retention described in our Privacy Policy.
We do not pre-screen or monitor your email content. However, we reserve the right (but not the obligation) to remove content or take action where we reasonably believe it violates these Terms or applicable law.
Jade exposes an MCP interface so that you may connect your own AI agent to your account. Jade does not provide an AI agent and does not operate one on your behalf. If you connect an AI agent:
- That agent will have full access to the content of your email, including message bodies and attachments;
- Your email content will be transmitted to, and may be processed by, the AI provider that operates your agent;
- You are solely responsible for the agent you connect, for the conduct of that agent, and for the terms, privacy practices, and security of its provider; and
- Jade is not responsible for what a connected agent does with your email content or for any AI provider's handling of it.
Jade itself does not send your email content to any third-party AI provider.
You may schedule deletion of your account at any time. Jade disables service immediately and normally provides a 30-day recovery period before permanent deletion; you may restore the account during that period or choose immediate permanent deletion. Canceling only a paid subscription is separate from deleting the Jade account. We may suspend or terminate your account if you violate these Terms, if required by law, or to protect the service or other users.
If your payment fails, our payment processor (Stripe) will attempt to charge your card again over a short retry period before your subscription is considered lapsed. If your subscription lapses (because retries fail or you do not renew), you will lose access to your inboxes and stored email, but Jade will continue to receive incoming mail addressed to you as a convenience. If your subscription remains lapsed for one year or more, we reserve the right to permanently delete your account data and stored email, as described in the Privacy Policy.
Jade is provided on an "as is" and "as available" basis. We do not guarantee any level of uptime or availability and do not offer a service-level agreement. We may modify, suspend, or discontinue all or part of the service at any time.
Lifetime plans. A lifetime plan provides access for the lifetime of the Jade service, not the lifetime of the user. If we discontinue Jade, lifetime access ends when the service does. We are not required to refund lifetime fees beyond what applicable law requires, but if we discontinue the service we will give lifetime customers reasonable advance notice and a window to export their email by IMAP.
Jade, the "Jade Email" name and branding, and all software, design, and content of the service (excluding your email content) are owned by Jade Email, LLC or its licensors. We grant you a limited, non-exclusive, non-transferable, revocable license to use Jade for your personal use under these Terms. No other rights are granted.
You may not reproduce, duplicate, copy, sell, resell, or commercially exploit any portion of the service, and you may not use the Jade name, logos, or visual design without our prior written permission.
To the fullest extent permitted by law, Jade is provided without warranties of any kind, whether express or implied, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the service will be uninterrupted, secure, error-free, or that email will always be delivered, received, or stored without loss.
To the fullest extent permitted by law:
- Jade will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits, data, email, or goodwill; and
- Jade's total aggregate liability arising out of or relating to the service or these Terms will not exceed the amount you paid to Jade in the twelve (12) months preceding the event giving rise to the claim.
Some jurisdictions do not allow certain limitations, so some of the above may not apply to you.
You agree to indemnify and hold harmless Jade Email, LLC and its members, officers, and agents from any claims, losses, liabilities, and expenses (including reasonable legal fees) arising out of your use of Jade, your content, or your violation of these Terms or applicable law.
We may update these Terms from time to time. If we make material changes, we will notify you by email or by posting notice within the service before the changes take effect. Your continued use of Jade after the effective date of the updated Terms constitutes acceptance.
These Terms are governed by the laws of the State of New York, without regard to its conflict-of-laws rules. Any dispute arising out of or relating to these Terms or the service will be brought exclusively in the state or federal courts located in New York, and you and Jade consent to the personal jurisdiction of those courts. Jade does not require arbitration.
These Terms, together with the Privacy Policy, are the entire agreement between you and Jade regarding the service. If any provision is found unenforceable, the remaining provisions remain in effect. Our failure to enforce a provision is not a waiver. You may not assign these Terms; we may assign them in connection with a merger, acquisition, or sale of assets. Neither party is liable for delays or failures caused by events beyond its reasonable control.
